Touchless Terms of Service

These terms describe what you may and may not do with Touchless, what the software is and isn't responsible for, and how third-party services that Touchless connects to are handled.

1. Acceptance

By downloading, installing, or using Touchless, you agree to these terms. If you do not agree, do not install or run the software.

2. License

Touchless is distributed under the Functional Source License v1.1 with an Apache-2.0 future grant (FSL-1.1-Apache-2.0). You may use Touchless for any internal or personal purpose. Two years after each released version's publication date, that version automatically converts to Apache-2.0 and becomes fully open source.

The full license text ships in the LICENSE file inside every Touchless install and is also available in the project repository.

3. Permitted use

  • You may run Touchless on machines you own or are authorized to use.
  • You may control your own apps, accounts, and devices through Touchless.
  • You may create, save, share, and modify outputs (drawings, screenshots, clips, recordings) produced by Touchless for your own use.

4. Restrictions

  • You may not use Touchless to access devices, accounts, or services you are not authorized to use.
  • You may not use Touchless to violate any third-party service's terms (for example, Spotify's, Google's, or YouTube's terms).
  • You may not use Touchless to capture, record, or transmit content from other parties without their consent where consent is required by law.
  • You may not repackage Touchless and distribute it as your own product before the FSL-to-Apache-2.0 conversion date for that version.

5. Third-party services

Touchless can optionally connect to third-party services to provide specific features. Those services have their own terms and privacy policies, which you accept by using the corresponding Touchless feature.

  • Spotify Web API. Optional. Used by the "Connect Spotify" feature so voice commands and gestures can control playback in Spotify. Authorization uses OAuth 2.0 with PKCE; Touchless never sees or stores your Spotify password. Use is subject to Spotify's terms.
  • GitHub releases. Used to check for and download Touchless app updates.
  • Cloudflare hosting. Used to deliver Touchless downloads and update payloads.

If a future Touchless feature explicitly sends user content to an outside AI or cloud service, that feature will be optional and disclosed in-product before use.

6. User content

Outputs you create with Touchless — drawings, screenshots, clips, recordings, custom gestures, settings — belong to you. Touchless stores them locally on your device unless you explicitly export or share them.

You are responsible for the content you capture, record, save, or transmit using Touchless, including respecting the privacy and intellectual property rights of other people.

7. Privacy

Camera, microphone, and dictation data are processed locally on your device. See the full Privacy Policy for details on what Touchless collects, what it does not, and which third parties it contacts on your behalf.

8. Updates

Touchless may check GitHub for new releases and download them automatically when one is available. You can disable automatic updates in Settings; you remain responsible for keeping your installation reasonably current.

9. Disclaimer

Touchless is provided "as is", without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Hand and voice recognition are probabilistic — Touchless may misclassify gestures or voice commands; do not rely on Touchless for safety-critical, medical, financial, or legal decisions.

10. Limitation of liability

To the maximum extent permitted by law, in no event shall the authors or contributors be liable for any direct, indirect, incidental, special, exemplary, or consequential damages arising out of the use or inability to use Touchless, even if advised of the possibility of such damage.

11. Termination

You may stop using Touchless and uninstall it at any time. Any rights granted under these terms end if you violate them, but the License conversion clauses (see the LICENSE file) continue to apply on the original schedule.

12. Changes to these terms

These terms may change as Touchless features change. The latest version will be posted on this page with an updated effective date. Continued use of Touchless after a change indicates acceptance of the updated terms.
